The officer proceeded to use force in removing the subject from the vehicle. The man was later charged \[ Grayson County Case # 2023-1-1062\] with a Class A misdomeanor for "Resist Arrest Search or Transport" under [Texas Penal Code 38.03(a)](https://statutes.capitol.texas.gov/Docs/PE/htm/PE.38.htm "Texas Penal Code Title 8 Chapter 38"): ![Texas Penal Code Sec. 38.03(a)](/sites/default/files/inline-images/Tx.Penalcode.38.03a.JPG)Texas Penal Code Sec. 38.03(a)The video shows no indication that the officer placed the driver \[subject of the use of force\] under arrest and a witness to the incident said that the officer was going to give the driver "a warning" and release him until the driver objected to the officer's accusation that he lied about his address. There is no indication from the available evidence that the man was under arrest before the potentially unreasonable use of force. Additionally, the use of force appears, from the video, to violate the Denison, Texas Police Department General Orders Manual Directive 6.01.1 Section 4 Paragraph B: ![Denison, Texas Police Department General Orders Manual Directive 6.01.1 Section 4 Paragraph B](/sites/default/files/inline-images/Denison.UOF_.policy1.png)Denison, Texas Police Department General Orders Manual Directive 6.01.1 Section 4 Paragraph BAnalasys of the video footage submitted shows two red lights were active on the officer's body camera footage, indicating that the device was powered on at the time of the incident, however to date \[02/19/2024\] despite an open records request being submitted, has yet to provide footage to the requestor or the defendant via discovery. The man sustained visible injuries and alleges that Officer Elmore denied him medical treatment. It is reported that not only did Officer Elmore, fail to render aid, but that upon taking the subject into custody, no photos were taken of the injuries and the officer entered false information into the report of "no injuries".
