## Statement

Craig Ladd has not disclosed to defense council or defendants that his assistant district attorney, Fern L. Smith, was named as a potential witness in an appeal (PCD-2022-589), to answer for withholding of exculpatory evidence and destruction of evidence in a capital murder case. See attached motion for evidentiary hearing naming Fern Smith as an anticipated witness.
