Court documents from a claim brought pursuant to 42 U.S.C § 1983 (Civil action for deprivation of rights) out of The Federal District Court for the Eastern District of OKlahoma (case # 13-CV-00512-RAW) indicate that on 09/13/2013, Munholland arrested a woman for an alleged misdemeanor driving violation, and handcuffed the subject behind her back.
"Unexpectedly and without warning Defendant Munholland forcefully placed his leg across [subject's] lower body and threw her to the ground face first while her hands were cuffed behind her back. Later that evening while [subject] was in the hospital awaiting surgery for her injuries Defendant Munholland described his use of force on [subject] as 'some kind of ninja karate move'."
The use of force by Munholland broke the subject's left leg. The breaks were severe enough that surgery was required to repair the damage and metal hardware was implanted into the subject's knee to stabilize the broken bones. The injuries sustained by the subject are permanent in nature. The subject was a female, height 5' 5", and approximately 120 lbs at the time of incident. The subject was unarmed and posed no realistic danger of flight or harm to anyone.
Exhibit # 2 in the case is an Affidavit, dated April of 2014, from Gary Wansick, then Chief of McAlester Police disclosing the internal investigation conducted by the department. He states that the advisory opinions, recommendations, or deliberations are "pre-decisional". He then states: "However, I was unable to issue a final decision, due to Officer Munholland's resignation notice with the McAlester Police Department on November 20, 2013, the the investigations is moot."
*NOTE*
OSCN Court records indicate that AFTER HIS RESIGNATION, Officer Dillin Munholland was the arresting officer, acting on behalf of the McAlester Police Department, for THREE cases, CF-2014-00795 (filed on 12/10/2014), CF-2015-00102 (filed on 1/29/2015), and CF-2015-00140 (filed on 02/12/2015).
Any consideration of rehiring or continued employment would no longer render the investigation "moot".
