The Brady List serves as a verified public accountability record of law enforcement officers, prosecutors, judges, and government agents whose conduct has raised questions of truthfulness, integrity, bias, or compliance with constitutional and professional duties.

Adding an individual’s profile ensures that due process, transparency, and public oversight are upheld across all jurisdictions.

### Who May Be Listed

An individual may be listed on the Brady List if they are, were, or are reasonably expected to be relied upon by prosecutors or the government as a source of testimony, evidence, or credibility representations in any criminal or quasi-criminal proceeding. This includes, but is not limited to:

- Law Enforcement Officers — Peace officers, correctional officers, investigators, or agents acting under local, state, or federal authority whose actions, statements, or reports may be used in criminal proceedings.
- Prosecutors and Members of the Prosecution Team — Individuals engaged in filing, pursuing, or dismissing criminal or quasi-criminal charges, or influencing prosecutorial discretion.
- Judges or Magistrates — Judicial officers responsible for adjudication, pretrial rulings, warrants, or sentencing, where impartiality or constitutional compliance is implicated.
- Government Agents and Employees — Any official performing investigative, enforcement, administrative, or quasi-judicial functions with material influence over due process or the deprivation of liberty.
- Testifying Individuals and Witnesses Relied Upon by Prosecutors — Any individual whose testimony, statements, findings, or reports may be presented, referenced, or relied upon by the prosecution, including:
    
    
    - Forensic scientists, analysts, or lab technicians;
    - Civilian or contracted witnesses assisting law enforcement;
    - Confidential informants, cooperating witnesses, or expert witnesses;
    - Employees or agents of governmental entities whose information, analysis, or testimony bears on material facts in dispute.

If a prosecutor, agency, or court relies upon an individual’s credibility or testimony, and that individual possesses information subject to disclosure under Brady v. Maryland or Giglio v. United States—including evidence of bias, misconduct, falsehood, or disciplinary findings—they are eligible for inclusion on the Brady List to ensure full constitutional disclosure prior to trial.
